Refinance Retainer and Intake Form

Congratulations on your upcoming real estate refinance or new mortgage!

Please note that at this time, Advent Legal has not been retained to represent you generally or in connection with any other matter.

In order to assess you upcoming refinance, please fill in the intake form below and upload the following:

  • 2 copies of ID (both sides) for each individual on title. One piece of ID must be Canadian/Federal or Provincial government-issued photo identification such as a driver’s licence or passport. Unfortunately, a health card is not acceptable identification;
  • A copy of your property tax bill for the current year and proof of payment;
  • A copy of the Condominium Status Certificate (if your property is a condominium);
  • A copy of your fire/home insurance binder; and
  • A copy of any existing mortgage/charge statements.

*NOTE - Under the Ontario Family Law Act, two parties can be declared common law spouses after they’ve cohabitated for at least three years unless they have had a child together and have cohabited in a relationship of some permanence. 1. Being married to another person nullifies the three-year requirement with the current partner until a divorce is obtained. 2. Temporary break-ups of the relationship that cause a break in cohabitation can delay or nullify the three-year requirement

Title of the Property

Please tell us who is on title for the property (i.e. who are the owners). Please enter the name(s) of all individuals who will be on title to the property. If you are adding someone to the title of the property please enter them as an individual and please describe how the original owner is related to the new person being added to title.

Does your mortgage require you to add someone else to title? Sometimes as part of the refinance additional borrowers are added to help with the refinance transaction. For every borrower that is on the mortgage we need to ensure that they are on title as well. For any individuals being added to title, please let us know who is being added. For changes to title, we charge an additional fee of $250 plus HST and disbursements to prepare and advise you on the transfer of title.

If the property is tenanted or will be tenanted then please provide us with copies of all lease agreements.

Mortgage Questions

When obtaining a refinanced loan or mortgage many lenders will require a payout of existing debts or other loans including credit card payments. If there are none, enter 0.

Property Taxes

Please provide us with a copy of your latest tax statement. Please also call your local municipality for a tax statement of account to be emailed to you that can then be forwarded to us. We need to ensure that no taxes are outstanding as part of refinance transactions.

Please let us know how your property taxes are paid to your local municipality (town, city, region, etc.)

Powers of Attorney and Tennants

Please provide the date of the document, where it was prepared, who prepared it and other important information. Please also upload a copy of the documents below in the document upload section. Please explain why a power of attorney is being used.

Below you can upload relevant documents relating to your property and closing. You can upload scanned documents or photos from a smartphone. "What if I don't have a scanner?" If you don't have a scanner but have a smartphone you can try to use a free scanner app such as Adobe Scan: Mobile PDF Scanner (Available for Apple iOS and Android ) which allows you to capture documents into a PDF using your phone’s camera.

Please upload any loan documents relating to your refinance

Please upload statements for all of the payout items requested to be discharged or paid out by the new lender by closing. We need these statements to obtain accurate discharge statements to payout the correct amounts. Before closing we will need full account numbers and addresses for all payees that need to be paid out.
